XIV. Notice of Allegations for Title IX Grievance Process
When the University receives a formal complaint signed by the Complainant or the Title IX Coordinator, the University will provide written notice to the parties that include the following:
- Notice of the University’s grievance process, including any informal resolution process.
- Notice of the allegations potentially constituting sexual harassment, as defined by the Title IX definition of sexual harassment, sexual assault, stalking, dating violence, and domestic violence, including sufficient details known at the time and with sufficient time to prepare a response before any initial interview, including:
- The identities of the parties involved in the incident, if known;
- The conduct that is alleged to be in violation of the policy;
- The date and location of the incident, if known;
- A statement that the Respondent is presumed not responsible for the alleged conduct, and that a determination regarding responsibility is made at the conclusion of the grievance process.
- Inform the parties of their right to have an advisor of their choice, who may be, but is not required to be an attorney.
- Inform the parties of any provision in the University’s code of conduct that prohibits making false statements or knowingly submitting false information during the grievance process.
- If during the course of the investigation, the University determines that there are additional allegations, the University will provide notice of the additional allegations in written form to both parties.
